• Coordination with insurance companies
• Temporary roof protection and water damage prevention

All services are subject to availability, weather conditions, safety considerations, and our professional assessment of your property's emergency needs.

3. Emergency Service Agreements

Emergency Response

• Emergency services are provided on a best-efforts basis during severe weather events
• Response times may vary based on weather conditions, demand, and safety considerations
• We prioritize calls based on severity of damage and safety risks
• Emergency service rates apply to after-hours and urgent calls

Service Assessment

• All services begin with an on-site assessment to determine the scope of emergency work needed
• Pricing is provided based on roof size, damage extent, accessibility, and materials required
• Customer approval is required before work commences
• Additional work discovered during service may require updated pricing and approval

4. Pricing and Payment Terms

Payment

• Payment is due upon completion of emergency tarping services unless insurance billing is arranged
• We accept cash, checks, credit cards, and can work with insurance companies
• Emergency service rates may include after-hours or holiday premiums
• A deposit may be required for scheduled (non-emergency) services

Insurance Claims

• We can work directly with your insurance company for covered damage
• Documentation and photos will be provided for insurance claims
• You are ultimately responsible for payment regardless of insurance coverage
• We recommend confirming coverage with your insurance provider

5. Customer Responsibilities

As a customer requesting emergency services, you agree to:

• Provide accurate information about the emergency and property damage
• Ensure safe access to the property and damaged areas
• Secure pets and notify us of any safety hazards
• Disclose any known structural issues or hazardous materials
• Understand that emergency tarping is a temporary solution
• Take reasonable steps to mitigate further damage

6. Service Limitations and Disclaimers

Temporary Nature of Service

Emergency roof tarping is a temporary measure designed to:

• Prevent further water intrusion and damage
• Provide temporary weather protection
• Buy time for permanent repairs to be arranged

Tarping is NOT a permanent solution and must be replaced with proper roofing repairs.

Weather and Safety Limitations

• We cannot perform work during active severe weather (lightning, high winds, etc.)
• Services may be delayed or rescheduled due to unsafe conditions
• We reserve the right to refuse service if conditions are deemed unsafe
• Weather conditions may affect the durability and longevity of tarping

7. Warranties and Guarantees

Workmanship Warranty

We warrant that our emergency tarping work will be performed in a professional and workmanlike manner. However, given the temporary nature of tarping:

• Tarps are designed for temporary protection (typically 30-90 days)
• High winds, additional storms, or extreme weather may compromise tarping
• We will make reasonable efforts to secure tarps properly
• Warranty does not cover damage from subsequent weather events

No Warranty Against Future Damage

We do not warrant that tarping will prevent all water intrusion or damage. Tarping is a mitigation measure, not an absolute guarantee against further damage.

8. Liability and Indemnification

Insurance

Enhance Home Solutions maintains appropriate liability insurance and workers' compensation coverage. Proof of insurance is available upon request.

Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claims shall not exceed the amount paid for services
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for pre-existing damage or hidden structural defects
• We are not responsible for damage occurring after tarping installation due to subsequent weather events
• We are not liable for delays in service due to weather, safety concerns, or high demand

Property Damage Disclaimer

While we take precautions to protect your property:

• Emergency situations may prevent full assessment of all property conditions
• Damaged roofs may have compromised structural integrity
• You should remove valuable items from affected areas before service
• We are not responsible for secondary damage resulting from the original emergency

9. Florida-Specific Provisions

Business Compliance

Enhance Home Solutions is fully insured and complies with all applicable Florida statutes and regulations for emergency roofing services.

Hurricane and Storm Season

• During hurricane season, demand for emergency services is extremely high
• We prioritize based on severity and safety considerations
• Response times may be extended during major weather events
• Pricing may reflect emergency demand and material availability

Right to Cancel

For non-emergency scheduled services, you have 3 business days to cancel contracts signed at locations other than our permanent place of business. Emergency services performed immediately may not be subject to cancellation rights.

• Deposits for emergency services are generally non-refundable once crews are dispatched

Cancellations by Company

We reserve the right to cancel or reschedule services due to:

• Severe weather conditions (active lightning, dangerous winds, etc.)
• Safety concerns for our crew or your property
• Inability to safely access the property
• Undisclosed hazardous conditions

In such cases, deposits will be refunded or applied to rescheduled services.

13. Permits and Compliance

Emergency roof tarping typically does not require building permits as it is considered temporary emergency mitigation work. However:

• All work complies with applicable local, state, and federal safety regulations
• Permanent repairs will require proper permits (arranged by your roofing contractor)
• HOA approvals are your responsibility if applicable
• We maintain all required state and local business licenses and insurance

14. Intellectual Property

• All content on our website, including text, graphics, logos, and images, is our property or licensed to us
• You may not reproduce, distribute, or create derivative works from our website content without written permission
• Our company name, logo, and trademarks are protected intellectual property
• We may use photos of completed emergency tarping work for marketing purposes unless you request otherwise in writing

Arbitration Agreement

• Arbitration will take place in Tampa Bay Area, Florida
• Each party will bear their own costs and attorney fees unless awarded by the arbitrator
• You waive your right to participate in class action lawsuits

Exceptions to Arbitration

Either party may seek relief in small claims court for disputes within that court's jurisdiction. We may also seek equitable relief in court for intellectual property violations.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the courts of Florida.

17. Emergency Disclaimer

IMPORTANT: Emergency roof tarping is a temporary damage mitigation service. It does NOT:

• Replace the need for permanent roof repairs
• Guarantee prevention of all water intrusion or further damage
• Serve as a long-term roofing solution
• Address underlying structural damage that may exist
• Constitute a permanent roof covering

You are responsible for arranging permanent repairs as soon as reasonably possible. Tarping is designed to buy you time to arrange proper repairs, not replace them.

Our website may contain links to third-party websites or services (including our partner Enhance Home Solutions for permanent roofing repairs). We do not control and are not responsible for the content, privacy policies, or practices of third-party sites. You acknowledge and agree that we shall not be liable for any damage or loss caused by use of third-party content or services.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

These Terms, along with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Enhance Home Solutions (TarpTheRoof) regarding our emergency tarping services and supersede all prior agreements and understandings.

You may not assign or transfer these Terms or your service agreement without our written consent. We may assign these Terms or any service contract to a successor, affiliate, or subcontractor without your consent.
